1. Who we are and what CAPERS is

CAPERS is a party-game app provided by Luke McAfee (“we”, “us”). It runs a night of games for a group sharing one phone: it picks games, deals prompts and challenges, keeps score, and looks back on the night at the end.

These terms are an agreement between you and us. By using CAPERS you accept them. If you do not accept them, do not use the app.

2. Who can use CAPERS

CAPERS is for adults. You must be at least 18 years old, and old enough to drink alcohol legally where you are if you choose to play any game in a drinking mode. Everyone taking part in a night should meet the same requirements.

The content includes adult themes, sexual references, strong language and drinking games. Choose the intensity your group is comfortable with; every game can be played without drinking.

3. Drinking and personal safety

CAPERS decides who takes a turn or a consequence and when. It never tells anyone how much to drink, how fast to drink, or to drink at all. Anyone can play without drinking, and anyone can be marked as not drinking on their profile, in which case they get a non-drinking forfeit instead.

You are responsible for your own choices and safety, and for respecting other people’s. Never pressure anyone to drink, to answer a question, to do a dare or to be photographed or recorded. Skip anything that is not right for your group. Do not play drinking games if you are under the legal drinking age, pregnant, taking medication that interacts with alcohol, or will be driving.

Dares and challenges must never be carried out in a way that is dangerous, illegal, or involves someone who has not agreed to it.

4. Your account

When the app can reach our servers, it creates an anonymous account for your install automatically. You can add an email address and password to use the same account (and any CAPERS Pro subscription) on another device. Keep your password to yourself; you are responsible for activity on your account.

You can delete your account at any time in Settings → Account. See the Privacy Policy for what that deletes.

5. What you put into CAPERS

Player names, nicknames, profile photos, crew names, written confessions, recordings and photos you make in CAPERS are yours. They stay on your phone; we do not receive them and claim no rights in them.

You must only add a photo, name or recording of someone who has agreed to it, and you must not use CAPERS to harass, humiliate, sexualise without consent, or record anyone secretly. You must not use CAPERS for anything unlawful.

6. Acceptable use

Do not: attempt to access other users’ accounts or data; interfere with, overload or probe our servers; reverse engineer the app except where the law allows it; bypass or tamper with purchase or entitlement checks; or copy and redistribute the app’s games or content.

7. CAPERS Pro subscriptions

CAPERS is free to play. CAPERS Pro is an optional subscription that unlocks the After Dark and Unhinged intensity tiers and the games in the After Hours pack. It is offered monthly and yearly, at the price shown in the app before you buy, which your app store sets in your local currency.

Payment is taken by Apple (App Store) or Google (Google Play) and charged to your store account when you confirm the purchase. A subscription renews automatically at the end of each period, at the same length and price, unless you cancel it at least 24 hours before the period ends. If a free trial is offered, any unused part of it ends when you buy a subscription.

You can manage or cancel a subscription in your App Store or Google Play account settings; cancelling stops the next renewal and Pro stays on until the end of the period already paid for. Deleting the app or your CAPERS account does not cancel a subscription.

Refunds are handled by Apple or Google under their own policies (and, where they apply to you, your statutory rights as a consumer). We cannot issue refunds for purchases made through an app store.

Pro follows the subscription status reported by your app store. Access may pause briefly while a purchase or renewal is confirmed, and ends if a payment fails after the store’s retry period, the subscription expires, or it is refunded.

8. Our content and the app

The app, its games, prompts, text, design and software belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use CAPERS for your own non-commercial entertainment in line with these terms and your app store’s terms.

9. Availability and changes

Most of CAPERS works offline. Accounts and subscriptions depend on our servers and those of our providers, which may occasionally be unavailable. We may change, add or remove games and features; if we materially reduce what CAPERS Pro includes, we will tell you in the app.

We may update these terms. We will show the date of the latest version here and, for material changes, tell you in the app before they apply.

10. Suspension and termination

You can stop using CAPERS and delete your account at any time. We may suspend or close an account that breaks these terms in a serious way or is used to attack our service. Closing an account does not cancel an app-store subscription; cancel it in your store settings.

11. Liability

CAPERS is a game. It is provided “as is”; we do our best to keep it working and its content appropriate, but we do not promise it will always be available or error-free.

We are not responsible for what players choose to do during a night, including drinking, dares, or photos and recordings they take. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.

Otherwise, our total liability to you in connection with CAPERS is limited to the amount you paid us for CAPERS Pro in the 12 months before the claim.

12. Law and contact

These terms are governed by the laws of England and Wales. If you live elsewhere in the UK or in the EU, you keep the protection of the mandatory laws of where you live and can bring a claim there.
